End-User License Agreement

1.1. The Marketplace is intended for use only by individuals residing in the United States of America. By using the Marketplace, you represent and warrant that you are a resident of the United States of America.

2.1. The User acknowledges that certain items traded through the Marketplace may be subject to varying legal status depending on the specific state within the United States of America.

2.2. The User is solely responsible for ensuring compliance with all applicable laws and regulations in their respective state regarding the items traded through the Marketplace.

2.3. The User agrees to independently verify the legality of any transaction conducted through the Marketplace in their state before engaging in such transactions.

2.4. The User assumes all risks associated with the use of the Marketplace and any transactions conducted therein.

3.1. The Company shall not be liable for any damages, claims, or legal consequences arising from the User's conduct on the Marketplace, including but not limited to the trading of items that may be considered illegal in certain states.

3.2. The User agrees to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from the User's use of the Marketplace or violation of this EULA.

4.1. The Company reserves the right to terminate or suspend the User's access to the Marketplace at any time, without prior notice or liability, for any reason whatsoever, including without limitation if the User breaches the terms of this EULA.

5.1. This EULA shall be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of law.

6.1. All content, features, and functionality of the Marketplace, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of the Company and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2. Users retain ownership of their content but grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Marketplace.

7.1. The Company collects and processes personal data in accordance with its Privacy Policy, which is incorporated by reference into this EULA.

7.2. Users consent to the collection, processing, and storage of their personal data as described in the Privacy Policy.

7.3. The Company implements appropriate technical and organizational measures to protect user data against unauthorized access, alteration, disclosure, or destruction.

8.1. Users agree not to engage in any activity that may interfere with or disrupt the Marketplace or the servers and networks connected to the Marketplace.

8.2. Users shall not attempt to gain unauthorized access to any portion of the Marketplace or any other systems or networks connected to the Marketplace.

8.3. Users shall not use the Marketplace to transmit any viruses, worms, or other malicious code.

8.4. Users shall not engage in any activity that violates any applicable laws or regulations.

9.1. The Company reserves the right to modify this EULA at any time. Users will be notified of any material changes to the EULA.

9.2. Continued use of the Marketplace after any such modifications constitutes acceptance of the modified EULA.
